Delta Sued Over Alleged Seatbelt Failure on Landing
A passenger who was knocked unconscious during a Delta flight is suing the airline, claiming the seatbelt failed due to negligent maintenance.

A passenger who was traveling on a Delta flight from Tampa to New York City has filed a lawsuit against the airline, alleging that the seatbelt failed during landing, causing him to be knocked unconscious.
Darrin Roth, from Bayside, Wisconsin, was traveling with his wife, Geralyn, when the incident occurred in January 2025. According to the lawsuit, the seatbelt failed upon landing, throwing Roth into the bulkhead and causing him to lose consciousness.
The couple is seeking compensation for the injuries Roth sustained, which include a heart attack and a cervical fusion operation. The lawsuit alleges that the seatbelt failure was due to negligent maintenance by Delta.
## Investigation into the Incident
Flight attendants inspected the seatbelt immediately after the incident and found signs of malfunction. The investigation into the incident is ongoing, but it is clear that the seatbelt failed during a routine landing.
Under the legal doctrine of res ipsa loquitur, seatbelts should not fail during ordinary operations for which they were designed. In this case, the fact that the seatbelt failed and the flight attendants observed problems with the seat provides evidence of a breach of duty by Delta.
## The Eggshell Skull Rule
The major legal battle in this case will focus on the scope of the medical compensation. Airlines often prefer to settle clear-cut equipment failure cases out of court to avoid public trials. However, in this case, the Roths may be able to pursue more damages under the so-called 'Eggshell Skull Rule.'
This rule states that a wrongdoer must take their victim as they find them. If a person has a hidden physical or mental vulnerability, the defendant generally remains fully liable for all resulting harm, even if it is much worse than expected.
## Possible Causes of the Seatbelt Failure
There are several possible causes of the seatbelt failure, including a failure of the mechanism, negligent work by maintainers, or a misrouted anchor. However, the most likely cause is a misrouted anchor, which could have been caused by a maintenance technician inverting the left and right sides or attaching the belt assembly facing the wrong direction during standard cleaning or seat refurbishment.
| Cause | Description | | --- | --- | | Failure of the mechanism | A failure of the internal springs and cams that lock the belt | | Negligent work by maintainers | A failure to properly maintain the seatbelt | | Misrouted anchor | A misrouted anchor caused by a maintenance technician |
The investigation into the incident is ongoing, and it is unclear what the final outcome will be. However, one thing is clear: the seatbelt failure during landing was a serious incident that has left the passenger with significant injuries.
